Agreement

      • Buyer, a person reviewing postings by sellers or communicating with sellers through JewelSonic®, agrees to the following terms as conditions of using JewelSonic®:
      • Buyer acknowledges that JewelSonic® does not warrant the accuracy or genuineness of articles posted by sellers. 
      • Buyer acknowledges that it's buyer and seller’s responsibility to determine the genuineness of the article offered for sale and to decide whether buyer and seller would benefit from having the item appraised.  Buyer acknowledges that all appraisals are done by independent appraisers rather than by JewelSonic®.  Buyer agrees that JewelSonic® is not responsible for any appraisal rendered and agrees to hold JewelSonic® harmless for any harm caused by an appraisal. 
      • Buyer warrants that that he or she is at least 18 years of age and able to form legally binding contracts.
      • Buyer warrants that JewelSonic® is not being used for any improper or illegal purpose and agrees to make JewelSonic® whole for any harm caused by buyer’s improper or illegal behavior while using JewelSonic®.
      • Buyer agrees that JewelSonic® is not responsible for the behavior of sellers who use JewelSonic® or for the content of postings on JewelSonic®.
      • Buyer agrees that he or she will not use JewelSonic® to harvest or collect user information or email addresses without the consent of users.
      • Buyer agrees that JewelSonic® has discretion to terminate buyer’s access upon a violation of the terms of use.
      • Buyer waives all right to a jury trial.
      • Buyer agrees that JewelSonic® is not liable for any consequential, reputational, or non-economic damages that buyer may suffer from using JewelSonic®.
      • Buyer agrees that all disputes arising out of or relating to buyer’s use of JewelSonic® shall be resolved in the Superior Court for the District of Columbia or United States District Court for the District of Columbia under the laws of the State of New York without regard to that state’s choice of law rules.
      • Seller, a person offering an article for sale on JewelSonic®, agrees to the following terms as conditions of using JewelSonic®:
      • Seller warrants that the article being offered by seller on JewelSonic® is to the best of seller’s knowledge genuine and that seller is the owner of the article. 
      • Seller acknowledges that it’s seller and buyer’s responsibility to determine the genuineness of the article offered for sale and to decide whether the seller and buyer would benefit from having the item appraised.  Seller acknowledges that all appraisals are done by independent appraisers rather than by JewelSonic®.  Seller agrees that JewelSonic® is not responsible for any appraisal rendered and agrees to hold JewelSonic® harmless for any harm caused by an appraisal. 
      • Seller agrees that posting of the article for sale will last for 90 days.
      • Refund Policy: Seller agrees that all fees paid to JewelSonic® for posting of an item are non-refundable.
      • Seller warrants that that he or she is at least 18 years of age and able to form legally binding contracts.
      • Seller agrees to post items only in their proper categories.
      • Seller agrees not to manipulate his or her asking price to avoid JewelSonic®’s fees.
      • Seller warrants that JewelSonic® is not being used for any improper or illegal purpose and agrees to make JewelSonic® whole for any harm caused by seller’s improper or illegal behavior while using JewelSonic®.
      • Seller agrees that JewelSonic® is not responsible for the behavior of buyers who use JewelSonic®.
      • Seller agrees that JewelSonic® retains the right to remove postings by seller that may create legal liabilities or are offensive or inappropriate without refund of any fees paid by seller to JewelSonic®.  Seller, further, agrees that JewelSonic® has discretion to terminate seller’s account upon a violation of the terms of use.  
      • By posting an article on JewelSonic®, seller agrees to give JewelSonic® a non-exclusive, irrevocable license to exercise any copyright, database, and publicity rights that seller may have in the article.  (This license is necessary for JewelSonic® to display your posting.)
      • Seller agrees that JewelSonic® postings may be unavailable at times due to technical or maintenance related problems or needs.
      • Seller agrees that JewelSonic® is not liable for any consequential, reputational, or non-economic damages that seller may suffer from using JewelSonic®.
      • Seller waives all right to a jury trial.
